Prudential acts as a Private Trustee Company of the Hague Master Trust, a huge, international
trust that originated in the Netherlands and holds assets from a number of European
and South American grantors. This trust has been involved in international projects,
business enterprises and finance for many years. After Nevis restructured its trust
laws in 1995, this trust was reconstituted under that Ordinance and Prudential was
reorganized to act as a Private Trustee Company under Nevis Law. In this role, Prudential
handles all of the normal trustee functions for the Master Trust and is also
responsible, under direct written instructions for the settlement of new sub-trusts
which may be made available for use in international "offshore strategies."
As Trustee for the Sub-trusts settled under this scheme, Prudential is responsible
for discharging the responsibilities of trustee to each new Sub-trust, in accord with
the law of Nevis (the country of the trust's domicile), the laws of the Bahamas (the
country where the Trustee is located and where administration is executed, the laws
of other countries that may be implicated because of their tax, securities or other
laws or because real estate or other assets may be situate there, the terms of the
deed of trust, and finally the advise and consent of the appointed Protector. This
is quite a task and requires constant interaction with law firms, accounting firms,
brokerage houses and other professionals. The highly trained staff efficiently handles
the thousands of transactions assigned, using the newest technologies, and time tested
procedures.
Before any action can be undertaken by the Trustee, the Protector must execute a
Protector's Consent form, authorizing the action.
