Once a potential client has communicated with the professional Staff at American Barristers,
P.A., Ltd., and confirmed the value of an offshore strategy, that firm will communicate with
Prudential Trustees, Ltd. in its capacity as the Trustee of the Hague Master Trust. The consent
of the Protector Committee of the Master Trust will be sought for the settlement of a sub-trust
to be used exclusively for the new client. Upon approval, the sub-trust will be settled and
assigned to American Barristers, P.A., Ltd. for inclusion in the strategically structure being
designed for the new client.
This procedure is the result of several thousand hours of research and consultation with tax
and asset protection attorneys and trust specialists in the U.S., Canada and several Caribbean
jurisdictions. Because of recent initiatives by the IRS and Revenue Canada to target taxpayers
who use trusts in an "abusive" way, it was necessary to reorganize the way in which trust
relationships work. By having each trust settled by the Trustee of a Master Trust, no client
ever becomes the Grantor, Settlor, Trustee or Beneficiary of any sub-trust. The Client controls
the appointment of the Protector and the Protector's Representative Law Firm. The Trustee is
not empowered to take any action at all without the consent of the Protector. The professional
staff at American Barristers, P.A., Ltd. can provide more detail to prospective clients, and
can facilitate compliance with the requirements of participation.
